When we refer to “Shamrock,” “our,” “we,” or “us,” we mean Shamrock Nutrasciences Pvt Ltd, a company incorporated under the laws of India, having its offices at 83 E, Hansraj Pragji Building, Off. Dr. E. Moses Road, Worli, Mumbai, Maharashtra 400018 and its parent, subsidiary and affiliate companies all of which determine the methods and reasons behind the processing of Personal Information. In some cases, specific products, applications or Services might have different or additional privacy terms. Should these terms conflict with the present Privacy Policy, the terms pertinent to the given product, application, or service will take precedence.

  • “Services” means online and offline offerings by Shamrock including but not limited to

  • “Sensitive Information” shall have the meaning as provided in Clause 1.2.
  • “Publicly Available” shall have the meaning as provided in Clause 1.3.
  • “User” means a natural person or any legal entity.

  • “Purpose” shall have the meaning as defined in Clause 3.2 and Clause 4.3.
  • “Practitioner” means a nutritionist, dietitian or any other healthcare professionals or similar institutions who are associated with or wish to be associated with Shamrock.
  • “SPI Rules” shall mean Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011.
  • “DPDPA” shall mean Digital Personal Data Protection Act, 2023.

1. Processing Personal Information

1.1 “Personal Information” is defined under the SPI Rules to mean any information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to a body corporate, is capable of identifying such person.

1.2 The SPI Rules further define “Sensitive Personal Data or Information” of a person to mean personal information about that person relating to:

    financial information such as bank accounts, credit and debit card details or other payment instrument details;

    physical, physiological and mental health condition;

  • iv

    sexual orientation;

  • v

    medical records and history;

    biometric information;

  • vii

    information received by body corporate under lawful contract or otherwise;

    visitor details as provided at the time of registration or thereafter; and

  • ix

    call data records

1.3 Personal Information does not include Publicly Available information or lawfully obtained, truthful information that is a matter of public concern. For purposes of this paragraph, “Publicly Available” means: information that is lawfully made available by judicial or local government records, or information that a business has a reasonable basis to believe is lawfully made available to the general public by the consumer or from widely distributed media, or by the consumer; or information made available by a person to whom the consumer has disclosed the information if the consumer has not restricted the information to a specific audience. Publicly Available does not mean information collected by a business about a consumer without the consumer's knowledge. 2. Where We Collect Personal Information From

2.1 Information provided directly: We collect Personal Information directly from Users/Practitioners who interact with our Sites or Services, visit our office locations, or communicate with us. All information that we ask for is mandatory unless indicated as being optional. If mandatory information is not furnished, the requested Service cannot be provided to its potential/ to the User's satisfaction.

2.2 Information collected through automated technologies: We collect Personal Information when our Sites are used, either directly or through our third-party analytics providers

This includes business partners with whom we collaborate to provide our services; advertising, marketing, digital and social media agencies; data brokers; analytics providers; search information providers; and credit reference agencies. Additionally, we also receive information from publicly accessible sources, such as public databases or social media platforms. Should you opt to register or sign in via a third-party account (such as Facebook or Google), said third party manages your account authentication. Consequently, Shamrock collects your name, email address, and other shared information as approved during the linking of your Shamrock account with the third-party account.

3. Utilization of Personal Information - For Users

3.1 User's utilization and access to the Services are contingent upon their acceptance of the Terms of Use, which inherently includes acceptance of the provisions outlined in this Privacy Policy. Should any User disagree with any aspect of these terms, they retain the option to promptly discontinue their use of Services.

3.2 It is important to note that all information furnished to Shamrock by a User, including Personal Information or any Sensitive Personal Data or Information, is provided voluntarily. You acknowledge that Shamrock may utilize such designated Personal Information or 'Sensitive Personal Data or Information' under the SPI Rules for the following purposes: (a) to facilitate the provision of Services to you, (b) for commercial purposes, and in an aggregated or non-personally identifiable format for research, statistical analysis, and business intelligence objectives, (c) for the sale or transfer of such aggregated or non-personally identifiable research, statistical, or intelligence data to third parties and affiliates, (d) for communication purposes to enhance your usage experience and gather feedback regarding Practitioners and their practices, (e) for addressing customer support-related issues, (f) for contacting you to finalize any incomplete transactions wherein your contact information was provided during the transaction process. Additionally, Shamrock reserves the right to employ the information provided by or about the User for the following purposes:

    • 3.2.1.1 Program and Event Communication: This includes relaying information about our or our partners' programs or events, such as webinars, conferences, contests, or survey;.
    • 3.2.1.2 Marketing Initiatives: We market our Sites, products, and Services through methods such as commercial emails, newsletters, targeted advertisements, phone calls, and SMS messages;

3.4 The information gathered through automated technologies serves the purposes described in the “Information Collected Through Automated Technologies” section above.

3.5 We may aggregate or anonymise information to render it incapable of identifying the source of such information in the interest of maintaining confidentiality of such information. In compliance with relevant laws in India, this information may be utilized for analytical purposes such as enhancing our Services, product development, identifying industry trends, and benchmarking. In cases permissible by law, aggregated or de-identified data might be shared with third parties, as described in the "Sharing Personal Information" section below.

3.6 The collection, sharing, utilization, and disclosure of information classified as Personal Information or Sensitive Personal Data or Information under the SPI Rules necessitates your explicit consent. Please note that there may be circumstances where Shamrock will not amend, delete, or update your Personal Information, including: (a) if the Personal Information constitutes opinion data retained solely for evaluative purposes, and (b) if the Personal Information is contained within documents pertaining to a prosecution that has not yet concluded.

3.9 Users have the option to access limited features of the Site without creating an account. However, in order to unlock full access to all features and benefits offered on our Site, Users must create an account. During the account creation process, Users are required to furnish the following information, recognized as Personal Information allowing identification by others, including Shamrock: name, User ID, email address, country, ZIP/postal code, age, phone number, password selected by the User. Additional information requested on the registration page, such as opting to receive promotional offers from Shamrock, is voluntary. Users should exercise caution when using online payment methods.

3.11 Shamrock may retain records of electronic communications and telephone calls received and made for appointment scheduling or other administrative purposes, aimed at facilitating the Services, providing customer support, conducting research and development, and enhancing the listing of Practitioners.

3.12 All Shamrock employees and data processors with access to, and involvement in, the processing of sensitive personal data or information are obligated to uphold the confidentiality of every User's Personal Information or Sensitive Personal Data and Information. Shamrock has implemented procedures and technologies consistent with industry best practices and in compliance with applicable laws to safeguard all personal data from collection to destruction. Any third-party data processor to which Shamrock transfers Personal Data must agree to adhere to these procedures and policies, or implement adequate measures independently.

4. Utilizing Personal Information - For Practitioners

4.1 All provisions outlined in this Privacy Policy are applicable to every Practitioner. It is mandatory for all Practitioners to thoroughly review and comprehend the privacy statements delineated herein before providing any Personal Information or Sensitive Personal Data or Information to Shamrock. Failure to do so necessitates immediate cessation of use of the Services and leave the Site

4.2 During the registration process of a Practitioner on the Site, certain information, including Personal Information and/or Sensitive Personal Data / Information, is gathered.

4.3 Practitioners' personally identifiable information, voluntarily provided to Shamrock, serves to describe and identify Practitioner. This information remains the exclusive property of Shamrock, with Practitioners retaining ownership. By providing this information, you consent to Shamrock collecting, using, processing, and/or disclosing it for the purposes outlined herein. Shamrock may utilize such information for commercial purposes and in an aggregated or non-personally identifiable format for research, statistical analysis, and business intelligence endeavors. Additionally, Shamrock reserves the right to sell or otherwise transfer such aggregated or non-personally identifiable research, statistical, or intelligence data to third parties and affiliates. Shamrock may also utilize the information provided by or about the Practitioner for the following purposes:

  • 4.3.1 Shamrock may engage in communication with Practitioners to introduce them to new products or services of Shamrock that may be beneficial to their practice or professional development.
  • 4.3.2 Shamrock reserves the right to reach out to Practitioners to get feedback on their experiences with Shamrock's products or Services. This feedback could aid in enhancing and refining existing offerings or developing new solutions.
  • 4.3.3 Shamrock may opt to publish the provided information on its Site, potentially including details regarding Practitioners, their practices, specialties, and other pertinent professional data.
  • 4.3.4 Shamrock may engage in the analysis of anonymized practice data, encompassing financial and inventory information, for commercial purposes.
  • 4.3.5 Shamrock may analyze the usage patterns of the Site to gain insights into how Practitioners interact with its products.

4.4 Shamrock automatically facilitates the listing of Practitioners' information on its Site. This Practitioner information is prominently displayed to Users when they search for practitioners, on the Site. Any personally identifiable information of Practitioners listed on the Site is not generated by Shamrock . Instead, it is provided to Shamrock directly by Practitioners who opt to enlist themselves on the Site or is sourced by Shamrock from the public domain. Shamrock displays this information on its Site in its existing state, without making any representation or warranty regarding its accuracy or completeness. Therefore, we strongly encourage Practitioners to regularly verify the accuracy and completeness of their information and promptly notify us of any discrepancies, changes, or updates. While Shamrock will take reasonable measures to ensure the accuracy and completeness of this information, we rely on Practitioners to provide accurate and up-to-date details.

4.5 Shamrock may additionally showcase information for Practitioners who haven't registered or partnered with Shamrock, given that these Practitioners have granted consent to Shamrock for collecting, processing, and/or disclosing their information on the Site. These Practitioners undergo verification by Shamrock or its associates, and Shamrock diligently strives to procure accurate information for them. Nonetheless, Shamrock does not assume liability for any inaccuracies or incompleteness in the information displayed on the Site for such Practitioners.

5. Sharing Personal Information

Shamrock places significant emphasis on safeguarding your privacy rights. Aside from the instances explicitly outlined in this Privacy Policy, Shamrock will disclose your Personal Information only if mandated by law, regulation, law enforcement agency, governmental official, legal authority, or similar requirements. 5.2 With our service providers. We may share Personal Information with service providers that perform services on our behalf for the purpose of:

  • 5.2.1 Storing Personal Information on our behalf (e.g., cloud computing service providers).
  • 5.2.2 Assisting us with our business operations and software and improving it (e.g., processing and analyzing Users’/Practitioners’ feedback); and
  • 5.2.3 Performing research, technical diagnostics and analytics with regard to the software.

5.3 Prior to sharing Personal Information with any service provider, Shamrock shall take measures to ensure the service providers agree and commit to complying with applicable laws in India, upholding strong data security, and handling Personal Information solely as per our instructions.

5.4 With partner organizations. We may share Personal Information with specific partners, as outlined below:

  • 5.4.1In instances when a third party, such as a, business or other entity grants you access to a Shamrock product or Service, we may share information concerning your usage, assessment outcomes, and inputted data not including confidential information which are regulated by separate express agreement;
  • 5.4.2 When you partake in a program or event where we have partnered or collaborated with third parties (such as a webinar, conference, or promotional event), we may share your information with the program/event sponsor;
  • 5.4.3 Where you have access to our content or Sites, or you have chosen to receive electronic alerts about blogs, or your contribution to one of our blogs or other works has been accepted for publication, we may share your information (such as your name, organization and email id, etc.), pursuant to your express consent, when such content is published on the Site).;

These policies encompass managerial, technical, operational, and physical security control measures tailored to the information collected and the nature of Shamrock's operations.

6. Confidentiality

6.1 Shamrock provides access to User/Practitioner information solely on a need-to-know basis, limiting it to employees, agents, partners, service providers and third parties. However, only employees are bound by strict confidentiality obligations.

6.2 One of Shamrock's functionalities is to aid practitioners in managing and organizing information. Consequently, Shamrock may retain and furnish all such records to the relevant authorities or to Practitioners who request access to this information. One aspect of Shamrock's functionality is to facilitate User’s access to their information. Consequently, Shamrock may retain and provide all such records to the respective User or their Practitioner.

6.3 Administrators at Shamrock do not have access to your password. It's vital for you to safeguard against unauthorized access to your password, computer, and mobile phone. Always remember to log off from the Site after use. Shamrock bears no responsibility for any unauthorized use of your account and password. If you suspect any unauthorized activity on your account, please promptly notify Shamrock by sending an email to support@reework.in. You are liable to indemnify Shamrock for any losses incurred due to unauthorized use of your account and password.

6.4 Notwithstanding the above, Shamrock cannot guarantee the confidentiality, security, or dissemination of your Personal Information by our partners and third parties beyond the scope of our agreement with them. Additionally, Shamrock shall not be held accountable for any breaches of security or actions of third parties or events beyond our reasonable control, including but not limited to, government actions, computer hacking, unauthorized access to computer data and storage devices, computer failures, security breaches and encryption issues, poor quality of internet or telephone services, etc.
